Report

The Board needs to take appropriate disciplinary action when licensees violate statute. Auditors identified instances where the Board dismissed complaints against licensees despite evidence of statutory violations. Additionally, the Legislature should consider granting the Board authority to issue Letters of Concern for those complaints where there is not sufficient evidence of a violation, but enough evidence to concern the Board. Finally, the Legislature should consider granting the Board the authority to conduct investigative hearings so that complaints meriting disciplinary action other than license suspension or revocation can be resolved in a timely manner. Currently, the Board must refer all complaints to formal hearing, which causes some complaint resolutions to be delayed.
